Terms of Service

1. Acceptance of Terms
By accessing or using Splyts (the “Service”), you agree to these Terms of Service and our Privacy Policy at splyts.com/legal/privacy. If you do not agree, do not use the Service.
2. Description of the Service
Splyts is a native iPhone application that helps self-coached athletes plan and adapt training. Features may include rolling training plans, Coach chat, a session player, post-workout analysis, Apple Health (HealthKit) integration, optional Strava integration, and optional Bluetooth sensors during live sessions.
The Service is not a social network — it does not include friends, feeds, or community features. There is no web application for full product use; pages on splyts.com are informational and for email signup.
3. Eligibility and Accounts
You must be at least 18 years old to use the Service. If you are under 18, you may not create an account or use the Service.
You create an account using Sign in with Apple and agree to provide accurate information, including your date of birth. You are responsible for activity on your account and for maintaining the security of your Apple ID and device.
Before connecting Apple Health or Strava, you must accept the current version of these Terms and our Privacy Policy. We may require you to accept updated Terms before continuing to use certain features.
You may delete your account at any time in Settings → Data & Privacy → Delete my account. We may suspend or terminate accounts for violations of these Terms or misuse of the Service.
4. Subscriptions and Payments
Paid features are offered through Apple In-App Purchase (StoreKit). Apple is the merchant of record. Pricing, billing period, free trials, and introductory offers are displayed in the app and on the App Store product page at the time you subscribe.
Before subscribing, new users may receive a limited number of free Coach messages as shown in the app. Additional AI features may require an active subscription or trial.
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Manage or cancel in iPhone Settings → Apple ID → Subscriptions.
We may offer preview access (including via Apple TestFlight). Preview access may be time-limited or withdrawn. When preview access ends, you may need to subscribe to continue paid features, or your account may enter read-only or restricted mode.
If your subscription ends, you may retain access to view certain data and use non-AI features, but AI coaching may be disabled until you resubscribe.
All purchases are subject to Apple’s refund policies. Price changes apply to subsequent billing periods as shown through the App Store before renewal.
5. Health and Medical Disclaimer
THE SERVICE IS NOT MEDICAL ADVICE. Splyts provides fitness and training tools for informational and coaching purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Splyts is not a medical device. Consult a physician or qualified health provider before starting or changing an exercise program. Health and fitness metrics may be inaccurate. Physical exercise involves inherent risk, which you assume.
6. User Content and Data
You retain ownership of data you provide. You grant Splyts a worldwide, non-exclusive, royalty-free license to host, store, process, and use your content solely to provide, maintain, and improve the Service.
You agree not to violate law, upload malicious code, harass others, use the Service for medical diagnosis or emergency services, or scrape, reverse engineer, or access the Service through unauthorized automated means.
You may delete your account in Settings. Deletion is permanent and may take up to 30 days to complete on our systems.
7. Third-Party Services
Apple Health, Strava, and other integrations are optional and governed by their own terms. If enabled, Splyts may update titles or descriptions on new linked Strava activities subject to your settings.
8. Intellectual Property
The Service, including software, design, coaching systems, and branding, is owned by Splyts or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
You may not copy, modify, reverse engineer, remove proprietary notices, access through unauthorized clients, or use the Service to build a competing product.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLYTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SPLYTS THROUGH THE APP STORE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) CAD $100.
11. Indemnification
You agree to indemnify and hold harmless Splyts from claims arising from your use of the Service, your content, or your violation of these Terms or any law.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations, risk to the Service, or discontinuation of preview programs. Provisions that should survive termination will survive.
13. Changes to Terms
We may modify these Terms at splyts.com/legal/terms. Material changes may be communicated by email or in-app notice. We may require re-acceptance in the app before connecting data or using certain features.
14. Governing Law and Disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein.
Contact support@splyts.com first to resolve disputes informally. To the extent permitted by law, you agree to bring claims only in your individual capacity, not as a class member.
15. Apple-Specific Terms
If you downloaded the app from the Apple App Store, these Terms are between you and Splyts, not Apple. Apple is not responsible for the Service, has no support obligation, and is a third-party beneficiary of these Terms.
For auto-renewing subscriptions purchased through Apple: payment is charged to your Apple ID; subscriptions renew automatically unless cancelled at least 24 hours before the period ends; manage subscriptions in Account Settings; any free trial converts to a paid subscription unless cancelled before the trial ends, as shown in the App Store flow at signup.
16. General
These Terms and the Privacy Policy are the entire agreement regarding the Service. If any provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent.
